DESIGN FOR…EVER: Protecting product appearance by trade marks and copyright?!

The Faculty of Law, Economics and Finance and DLA Piper, together with the Benelux Office for intellectual Property and AIPPI Luxembourg, are delighted to invite you to the third lecture of their lecture series “Lëtz talk IP!” .
 

Abstract
Trademark and copyright law can encroach on design law when protecting product appearances. Seeking design protection outside of design law can be appealing for various reasons, particularly due to the longer duration of protection. Tomas Westenbroek will explore and explain the challenges, opportunities, and flexibility within trademark law regarding design protection. Simon Geiregat will critically analyze the potential of copyright law. By juxtaposing the BGH Birkenstock judgment with CJEU decisions and recent national case law in the Benelux, the speakers will attempt to identify emerging trends.

The talk will be followed by a reception.
